These Terms of Service govern your use of thewebcreature.com and your engagement with The Web Creature for any services. Please read them carefully. By using our website or services you accept these terms in full.
By accessing this website or engaging The Web Creature for services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.
The Web Creature provides digital services including web development, mobile app development, software development, AI solutions, and digital marketing. The specific scope, deliverables, timeline, and pricing for each engagement are defined in a separate Statement of Work or proposal document agreed upon by both parties.
Upon receipt of full payment, all custom work produced by The Web Creature for a client project becomes the intellectual property of the client. We retain the right to display completed work in our portfolio unless explicitly agreed otherwise in writing.
Third-party components (open-source libraries, licensed fonts, stock imagery) remain subject to their respective licences. We will notify you of any third-party components used in your project.
Payment terms are specified in each project proposal. Generally:
A deposit is required before work commences.
Remaining payments are tied to project milestones or delivered monthly for retainers.
Invoices are due within 14 days of issue unless otherwise agreed.
Late payments may attract interest at 1.5% per month on outstanding amounts.
Work may be paused on accounts overdue by more than 30 days.
Clients agree to:
Provide timely feedback and approvals to keep projects on schedule.
Supply all required content, assets, and access credentials in a reasonable timeframe.
Ensure they have the rights to any content or materials provided to us.
Maintain the confidentiality of any login credentials we provide.
Both parties agree to keep confidential any proprietary or sensitive information shared during an engagement. This includes technical specifications, business strategy, pricing, and client data. This obligation survives termination of the engagement.
To the maximum extent permitted by law, The Web Creature's liability for any claim arising from our services is limited to the total fees paid by the client for the specific service giving rise to the claim.
We are not liable for indirect, incidental, or consequential damages including loss of revenue, data, or business opportunity arising from the use of our services.
We warrant that:
Services will be performed with reasonable skill and care.
Deliverables will materially conform to agreed specifications.
We have the right to provide the services described.
We do not warrant that our services will be uninterrupted or error-free, or that deliverables will meet specific business outcomes.
Either party may terminate an engagement with 30 days' written notice. Upon termination, the client is responsible for payment of all work completed to the termination date. We will deliver all completed work and hand over relevant files and credentials within 14 days of termination.
These terms are governed by the laws of India. Any disputes arising from these terms or our services will be subject to the exclusive jurisdiction of the courts of India.
We may update these terms from time to time. Material changes will be communicated to active clients. Continued use of our services after changes constitutes acceptance of the updated terms. The current version is always available on this page.
